General Terms and Conditions of Business and Conditions of Carriage


1. Prices

The prices in the current price list apply. We reserve the right to correct any calculation errors. Flat-rate offers are only valid for a specific order for a short period of time.


2.Orders

Orders are generally executed in the manner in which they were placed by telephone, in writing, or by telex, and confirmed in writing. Acceptance of the contract (the scope of the contractually owed service) is determined exclusively by the written order confirmation from ANT Transport GmbH. The customer undertakes to carefully review the contents of the order confirmation. Orders of any kind must clearly identify the subject matter of the transaction. Amendments, confirmations, or repetitions must be marked as such. Verbal agreements require written (or telex) confirmation.


3.Special features of the shuttle service

ANT Transport GmbH will confirm a customer's driving order by email, including the order details such as the pickup date, location, and time. The pickup time must be strictly adhered to; otherwise, the right to transport will be void (after a maximum of 15 minutes of waiting time for the ANT Transport GmbH driver) and will be charged to the customer as a so-called "waiting time." The customer must be reachable by telephone during the pickup period (15 minutes before or after the agreed time); otherwise, a timely pickup may not be guaranteed. A pickup is considered timely if it occurs within the pickup period. If the pickup by an ANT Transport GmbH driver does not occur within the agreed pickup period, the customer must notify ANT Transport GmbH. When using the ANT Transport GmbH Airport Shuttle Service, the customer is generally picked up at the airport from the respective meeting point in the terminal. The customer is responsible for locating the ANT Transport GmbH driver waiting at the meeting point, who will be identified by a name tag or the ANT Transport GmbH company logo. In the event of changes to flight or landing times, ANT Transport GmbH will endeavor to arrive on time. ANT Transport GmbH is aware of flight delays. For short-notice transfers, ANT Transport GmbH reserves the right to charge an additional express fee of €15 gross. Short-notice transfers are defined as follows: same-day transfers and bookings after 6:00 PM for the following day. This fee may also apply for short-notice rebookings/changes. We assume no liability for legal claims resulting from delays beyond our control. This means that we are responsible for determining the pick-up time for the guest. If the guest requests a different pick-up time than suggested by us, the risk is transferred to the guest. We transport our guests so that they arrive at the airport two hours before departure.


3.1 Waiting time

The free waiting time on the return journey is 30 minutes (arrival time according to order confirmation). After that, waiting time will be charged. Waiting times may occur if a flight arrives at the airport early or late. If subsequent orders are already pending, these will be given priority, and waiting times cannot be ruled out within reasonable limits. If the appointment is changed without consulting us, the passenger is not entitled to transportation, reimbursement, or price reduction.


4. Fare / commission

If cash payment has been agreed, the fare must be paid to the ANT Transport GmbH driver at the latest upon completion of the order. If an order is for a round trip, the entire fare must be paid to the ANT Transport GmbH driver upon completion of the first trip. If invoicing has been agreed, the due date is according to the specified payment term. The invoice amount must be transferred to the specified ANT Transport GmbH account within 14 days, stating the invoice and customer number. If orders are carried out for the benefit of a third party, the corresponding order fee must be paid by the client in case of doubt. In the event of default, default interest will be charged in accordance with the statutory provisions (Section 288 of the German Civil Code). If a debt collection agency is commissioned in the event of late payment, the customer must bear the resulting costs.


5. Luggage

A maximum of two pieces of normal-sized luggage per person is permitted. Additional luggage or bulky items must be declared when booking the trip; otherwise, they will not be transported. ANT Transport GmbH may charge additional fees for such items. The amount of these additional fees will be communicated upon request.


6. Withdrawal / Cancellation fees

The contracting parties have the right to cancel the transport order. Cancellations must be made in writing. Free cancellation of an airport shuttle service is only possible up to three hours before the start of the journey. If the customer fails to take a trip (so-called "no show") or cancels the transport order within three hours before the start of the journey, ANT Transport GmbH reserves the right to invoice the customer for the full order volume or the full fare. The customer reserves the right to prove that no damage or significantly less damage has occurred than the order/fare compensation demanded by ANT Transport GmbH. Individual cancellation conditions remain unaffected. In the event of disruptions to normal operations due to force majeure (weather, traffic, breakdown), no recourse can be made against us. In the event of a vehicle breakdown, we will continue to transport the passengers at our own expense.


7. Prohibited uses

Vehicles from ANT Transport GmbH may not be used a) for the transport of dangerous substances of any kind b) for the commission of crimes within the meaning of the German Criminal Code (§§ 1-9 StGB), even if these are only punishable under the law of the place where the crime was committed c) for journeys that go beyond the contractual use The customer is prohibited from determining the ANT Transport GmbH driver for the uses listed under points a)-c).


8. Customer liability

a) The customer is liable without limitation for all damage to the vehicle caused by him through his negligence, i.e., intentional or negligent damage, and for all damages caused to the driver personally by ANT Transport GmbH. b) Furthermore, the customer is liable without limitation and personally for all damages caused by use for prohibited purposes. c) The statutory liability provisions remain unaffected. Any damage resulting from transmission errors, misunderstandings, and mistakes in telephone, (tele)written, or email communication with the customer or with third parties shall be borne by the customer, unless the damage was caused by ANT Transport GmbH. For security reasons, ANT Transport GmbH reserves the right to obtain confirmation of orders received by telephone, (tele)written, or email. If telephone, (tele)written, or email communications are confirmed in writing, the customer must immediately object to any discrepancies between these communications and the written confirmation.


9. Liability of ANT Transport GmbH

ANT Transport GmbH is liable for all damages caused to the customer through negligence, i.e., intentional or negligent damage, provided that the damage is covered by the motor vehicle liability insurance taken out for the relevant vehicle. In the event of delay, liability only applies in cases of gross negligence or intent. Ant Transport GmbH may commission third parties, in whole or in part, to carry out all business assigned to it in its own name if it deems this justified, also after weighing the interests of the customer. If ANT Transport GmbH makes use of this option, its responsibility is limited to the careful selection and training of the commissioned third party. No liability is assumed for the consequences of delays due to traffic congestion, traffic jams, force majeure, or unforeseeable vehicle breakdown. ANT Transport GmbH is also not liable for theft of luggage by third parties.


10. Claims for damages

Claims for damages against ANT Transport GmbH are only due if they are free of objections and objections to the reason and the amount asserted. If claims for damages result from a traffic accident, a claim only exists if there was a prior opportunity to inspect the investigation file. For all other claims asserted against ANT Transport GmbH, ANT Transport GmbH will only pay based on invoices that meet general legal requirements. For indirect claims for damages, liability is limited to eight times the net fare.


11. Subject to change

In principle, the vehicle ordered will be provided. Should it be impossible to fulfill the order due to internal company reasons or objective impossibility, ANT Transport GmbH reserves the right to provide an alternative vehicle. ANT Transport GmbH will endeavor to keep the deviation from the ordered vehicle as minimal as possible, taking into account the usual intended use and possible uses.


12.Data storage

The customer agrees that ANT transport GmbH may store his personal data for company purposes.


13. Place of jurisdiction

For all disputes arising from or in connection with the contract or the contractual relationship, Munich is agreed as the place of jurisdiction, provided that a) the customer is a merchant in accordance with Section 1 of the German Commercial Code (HGB) b) he is a person equivalent to a merchant within the meaning of Section 38 Paragraph 1 of the German Code of Civil Procedure c) he has no general place of jurisdiction in Germany d) he has relocated his domicile or habitual residence abroad after conclusion of the contract e) his domicile or habitual residence is unknown at the time the action is brought.
